 Who is a Plan Fiduciary?                                                                                                                                  A fiduciary is any person who:

1)      Is named in the plan document as a fiduciary or is appointed as a fiduciary

2)      Exercises discretionary authority or control over the management of the

           plan, or

3)      Provides investment advice for compensation with respect to plan assets

 Plan fiduciaries have responsibility for the administration of the plan or the selection of investment options. Every plan must have a least one named fiduciary. It’s been our experience that the plan sponsor is generally a named fiduciary. (read more)

408(b)(2):                                                                                                                                                              This is a new regulation, dealing with fee disclosure to Plan Sponsors (employees who have plans), effective April 1, 2012. This requires all Covered Service Providers (those providing services to the plan for compensation) to disclose all compensations received from the plan.  This is true whether the compensation received is direct (paid from the plan directly) or indirect (paid for by a 3rd party).
